Board In Action - October 7, 2008

Here are the highlights from the October 7, 2008, Town of Canandaigua Board meeting.

There was a moment of silence for Earl LaCrosse.

The Board accepted the land donation for trails from James Judkins for the old peanut railroad right of way.

Public Hearings: The Board continued the public hearing until the November 18, 2008, meeting on the expenditure of up to $205,875 from the open space capital reserve fund for purchase of up to 25 acres from the Miller farm off Bristol Road/Route 21 South and Bliss Rd. There are issues to be resolved revolving around the differences between open space and park land and the eligibility for the grant money.

Privilege of the Floor: There was a plea to restore funding in the 2009 Town budget for the drug prevention program at the Canandaigua Schools and a request for a 5% increase in funding to the Wood Library instead of the proposed 3.5% in next year's budget. 5000 people from the Town use the library.

Priority Business: The Board moved the November 4, 2008, Town Board meeting to November 6th at 6:00 PM because of Election Day.

Committee Reports:

  • Codes Committee: Nothing new.
     
  • Fire Committee: Waiting for the October 23, 2008, report from the Fire Chief.
     
  • Comprehensive Plan Committee: The Citizen Advisory Committee will be composed of 7 members, one each from the Town Board, Planning Board, Parks and Recreation, and Trails committees plus three residents. They still are looking for a resident from the agricultural sector for the update of our Comprehensive Plan.
     
  • Parks and Recreation Committee: The Committee commended Jim Hecker and his highway crews for their great job on Firehouse Park. Firehouse Park is located off Route 332 behind the fire station. It now has an extended walking path and trees along with a pond for the public to enjoy.
     
  • Conservation Committee: The PDR for the Hicks property is going well.

Department Reports:

  • Planning Department: Still waiting for contract extension for the PDR on Middle Cheshire Road. The Planning Board is in the process of reviewing the Final Environmental Impact Statement for the RSM development at German Brothers Marina and the Johnson property.
     
  • Highway Department: Looking for a DOT speed study for Route 364.

Resolutions: The Board approved the acceptance of land from Old Brookside section 3 by developer. They approved the revised employee handbook. They approved the appointment of Phyllis Goodwin to the Board of Assessment and Review. They also approved a budget transfer of $47,000 into the attorney fees budget.

Payment of the Bills: The dispute over attorney fees continues with the Board only paying undisputed portions of the Planning Board Attorney fees at this time.

The Supervisor reported that the Appellate Division ruled in the Town's favor on the Quail Summit tax exemption.

New Motions from the Board: The Board approved a motion to seek the Attorney General's opinion on Planning Board attorney fees. They also voted to nullify a contract signed by the Supervisor and to review all bills related to this matter.

Executive Session: The Board returned from executive session to approve the hourly rate paid to the contract Planner.
